each pilot-in-command has the final authority and responsibility for the safe operation of his
ACFT
and
may use a different flaps setting approved for that

if he determines that it is necessary in the
interest of safety.
2.7 Special Noise Abatement Procedures for Arrivals at Night between 2200 and 0459
In addition to the rules already published, the following procedures will be applied by

3.1 General

3.2 Standard Instrument Departures
See 9, Routes Description and EBBR-AD-2.24, Departure Charts.
The Standard Instrument Departures (
SID
s) constitute noise abatement procedures. Therefore, it is
emphasized that pilots, except when being radar vectored, shall adhere to these routes as closely as
performance criteria permit. If unable to comply with these procedures, they shall advise
ATC
immediately.
3.3 Climb Gradient
In order to minimize noise disturbance and to clear obstacles in the
DEP
area,
ACFT
shall maintain a net
climb gradient of not less than 7% until passing 3 200
ft

. If unable to comply, pilots shall advise
ATC
accordingly on requesting start-up clearance.
